The Role of Prosecutors in Bangladesh---Some suggestions

In Bangladesh, the prosecutors are engaged in conducting Govt. cases, appeals and defend the Govt. in different courts. They enjoy sufficient discretion in conducting cases, compounding and withdrawing the same from courts. They should continue enjoying this discretion. In investigation, the prosecutors have little role. But they should have authority to examine evidence collected, give necessary guidance on the course of investigation and give opinion before submitting charge sheet. This will make the charge sheet judicially sound. The weak cases will be dropped at the beginning saving money of the Govt. and litigating people and time of the courts. It will also save many from harassment of being involved in suspicious cases.

Recently, crimes like illegal trafficking of drugs, women, children and money laundering have increased. All these have necessitated the increased international role of prosecutors. They may be involved in creating international co-operation in prosecution of cross-country criminals, supply of evidences and documents, transfer of accused, fugitives and war criminals. This will help in creating an internationally uniform system of law, procedure and adjudication, collecting and storing of information for exchange among the co-operating countries. Thus they will be able to fruitfully contribute to world peace.
